CLARITY Act stalls eleven votes short of cloture in a 49-50 Senate vote

Polymarket's contract on 2026 enactment roughly halved to about 17 percent before the roll call closed. The framework that failed was written for a US market of 67 million users.

What happened

Why it matters

Four Republicans voted no. Converting all four would have put the count at 53, seven short of the 60 that Senate Rule XXII has required since its current form was adopted in 1975 [3][11][2]. The roll call recorded 99 of the chamber's 100 seats [3].

The House passed the same bill 294 to 134 in July 2025, with 78 Democrats joining every Republican, which is 68.7 percent of votes cast [9][4]. The Senate produced 49 of 99, or 49.5 percent [5], on a text the sponsors had amended 126 times at Democrats' request across a 15-month Senate process [5]. Senator Cynthia Lummis, who announced in December 2025 that she would not seek reelection, said on X that "there is nothing left to give" [14].

Polymarket's CLARITY Act contract had 2026 enactment near 34 percent on Monday and about 17 to 18 percent once the Republican rejection of the Democratic counteroffer was known, according to TechTimes [7]. The price halved in a morning [6]. The remainder, roughly one chance in six [8], buys procedure. 1inch Chief Legal Officer Orest Gavryliak said, "Legislation of this scale rarely moves in a straight line, and a cloture vote can be brought again" [15]. Accounts of what was preserved differ: PYMNTS reports Tillis voted no to keep the ability to seek reconsideration [3], while Crowdfund Insider says he switched from yea to nay on a motion to recommit [4].

What the talks broke over is money that can be counted. Senators Mark Warner and Adam Schiff said the substitute bars new issuance of digital assets by public officials and their spouses but does not compel the president to divest existing revenue-sharing arrangements that generated more than $1.4 billion in reported 2025 income [12]. About $636 million of that is TRUMP memecoin royalties and more than $500 million is tied to World Liberty Financial, in which the Trump family holds a controlling 60 percent stake and an affiliated family company takes 75 percent of token sale revenue [13]. Those two lines cover at least $1.14 billion of the disclosed total [7].

Javier Martinez, CEO and former Chief Legal Officer at sFOX, said of institutions: "They read it as another quarter of uncertainty, and they price that in" [16]. Mohammad Akhavannik, Managing Director of the Newton Foundation, said "Regulators didn't need this bill to act on compliance; Treasury and FinCEN already have that authority, and they've used it before" [19]. Bitcoin, Ethereum and other large cryptocurrencies fell on the No vote [22].

In my view this repriced timing, not demand, and the House margin plus the public industry ask are why. The counter-case depends on the midterm calendar. Adam Morgan McCarthy, Lead Researcher at London-based LO:TECH, said "The debate on a federal framework carries on, and depending on how the midterms land, this bill could be dead within two months" [17]. Decrypt reported before the vote that several Republicans were wavering over bank objections, with eight banking trade groups including the American Bankers Association pressing their case, and that the Sunday text had already added a stablecoin circuit breaker aimed at deposit flight from community banks [26][27]. If Collins, Hawley and Moran were voting that objection, a post-midterm retry does not recover them. If cloture is refiled and carries before November, Monday's 34 percent was the accurate price and Tuesday was noise.
