Brussels moves ChatGPT, Reddit and Roblox into the DSA's strictest tier
The designation converts a growth number into a standing operating cost. Whether that cost or the fine ceiling is the bigger figure depends entirely on how much revenue a company actually has.

What happened
- The European Commission designated ChatGPT as a Very Large Online Search Engine and added Reddit and Roblox to the Very Large Online Platform category on August 31, 2026.
- Reddit reported 57.2 million EU monthly users in July and Roblox 46.6 million, both clearing the Digital Services Act's 45 million average monthly user threshold.
- Designated services must open data to vetted researchers, submit to an independent yearly audit, run an internal compliance function and offer a recommender option that does not profile the user.
- Failing to assess and mitigate the systemic risks the Commission lists can draw a penalty of up to 6% of annual worldwide turnover.
- The regulated list now runs to 28 services, and Henna Virkkunen said the Commission will not hesitate to designate any platform that meets the threshold.
Why it matters
- cost Peers puts continued defiance of a Commission order at up to 5% of global turnover a day, which is 20 days to a full year of revenue, so fighting an order by simply not complying is priced out of the strategy set before the lawyers arrive.
- constraint A profiling-free recommender is a build rather than a filing, and it lands on the ranking surface itself, so a quarter of engineering and product time goes to a second feed and an audit trail instead of anything a user asked for.
- precedent A chatbot has now been filed as a search engine under the DSA, which means the next AI assistant to cross the EU user threshold arrives with the classification template already written for it.
- contradiction Cryptopolitan dates the first deadline to end-December 2026 and PYMNTS to end-January 2027, and that month decides whether the risk assessment is a Q4 cost or a Q1 one.
An industry-commissioned 2025 study put the annual cost of living inside the DSA regime for a large US firm at roughly $150 million [22], and because the penalty ceiling is 6 percent of worldwide revenue [4], the two numbers cross at $2.5 billion of turnover [23]. Below that line the recurring bill is the bigger figure; above it the fine is. Which is the whole point, because one of those numbers is contingent on a Commission decision and the other is payroll, tooling and audit fees that recur whether or not anyone in Brussels is annoyed with you.
The clearance margins are worth sitting with. Roblox reported 46.6 million EU monthly users against a 45 million threshold [29][3], which is 1.6 million of headroom, or 3.6 percent [30]; Reddit's 57.2 million puts it 27 percent over the line [9][24]. Roblox's general manager for Europe, Joost Hagesteijn, welcomed the designation and invited further constructive engagement with the regulator [18], and the company pointed to age-check systems for chat and content it says it already pioneered [17], which is how a firm talks when it has already spent the money and would prefer the requirement stay in place for everyone else. Reddit did not reply to PYMNTS' request for comment [25].
Getting out is the expensive part. Amazon and Zalando both lost General Court challenges to their VLOP status and have appealed to the Court of Justice, according to legal scholar Steve Peers [20], and in Amazon's case the argument that the regime infringed its freedom to conduct a business ran into a court that accepted the rules impose high costs and ruled the burden justified anyway [21], leaving cost off the table as a defence.
The counter-thesis, and it is a good one, is that 6 percent is a ceiling nobody intends to reach. The Commission's July record includes a 550 million euro fine against AliExpress over counterfeit goods [13], preliminary findings against TikTok over the safety of minors' accounts [14], and an accepted compliance plan from X [15]: one cash penalty, two process outcomes. So the modal result for these three is an audit invoice and a negotiated plan, and the number to model is the run-rate rather than the ceiling.
This is probably wrong in one of two ways. If the Commission's first move against any of the three looks like the AliExpress order instead of the X plan, the contingent number becomes the real one. The more interesting version is OpenAI's: Crowdfund Insider reads the designation as covering a hybrid service rather than search alone, noting the Commission could have limited it to search and did not [8], while OpenAI's own spokesperson framed it narrowly, saying ChatGPT search operates as a search service under the DSA and that the company is preparing for the additional requirements [16]. Since the AI Act already governs ChatGPT [5], the scope question decides whether OpenAI is running one compliance function or two over the same surface, and at that point an industry average stops being a useful estimate of anything.
What to watch
- Whether Roblox's EU monthly average holds above 45 million, and what the Commission does with a designated service that drops back under the line.
- Whether the first Commission move against any of the three is a formal proceeding or an accepted compliance plan.
- Whether OpenAI's risk assessment is scoped to ChatGPT search or to the whole product, which decides if it runs one compliance function or two.

The list of services regulated under the DSA now numbers 28.

ChatGPT's designation followed disagreements over whether the chatbot was a platform or a search engine; OpenAI claimed 120 million users as of last year, and Brussels eventually filed it in the search engine sub-category.
- [8]
Crowdfund Insider reports the EU treated ChatGPT as a hybrid system placed in the search category, that the Commission could have targeted search only and chose not to, and that ChatGPT must now risk-assess for illegal content.
- [9]
Reddit reported 57.2 million EU users in July.
- [10]
Henna Virkkunen, the Commission's executive vice president for tech sovereignty, security and democracy, said the three services will be held to a higher standard of scrutiny and accountability and that the Commission will not hesitate to designate any platform that meets the threshold.
- [11]
Systemic risks to be assessed and mitigated cover dissemination of illegal content, negative effects on minors, users' physical and mental well-being, fundamental rights, electoral processes and public security.

- [20]
Both Amazon and Zalando lost General Court cases contesting their VLOP status and have appealed to the EU's Court of Justice, per Steve Peers.

An industry-commissioned 2025 study put the DSA cost for a large US firm in the regime at about $150 million a year.
- [23]
The $150 million annual compliance estimate equals a maximum 6% fine at $2.5 billion of worldwide revenue, so below that revenue level the recurring cost exceeds the worst-case penalty.
