Cuomo warns crypto that its Republican-heavy spending alienates the Democrats CLARITY needs

Add the money spent against Democrats to the money spent for Republicans and the tilt is close to three to one. Tech Influence Watch counts $54.3 million supporting Republicans and $23.2 million opposing Democrats, together $77.5 million, against $26.2 million supporting Democrats [2][3][19]. Of the $103.7 million the tracker has logged this cycle, about 75% favours Republican outcomes [20]. "When you invest heavily in the Republican Party, by definition, you're going to alienate Democrats," Cuomo said on a Token2049 panel with OKX chief executive Star Xu [4][1].

Individual slates are less lopsided. Fairshake's House list is 59% Republican [22].

The House vote was mixed as well. When the chamber passed CLARITY in July 2025, 78 Democrats joined 216 Republicans while 134 Democrats voted no [6], so about 37% of the Democrats voting backed it [21]. The Senate is where the bill stopped. All Senate Democrats and four Republicans voted against advancing it in September [7]. Many of their concerns at the time were tied to potential conflicts of interest involving Trump's crypto businesses, Cointelegraph reported [7].

November splits three ways for the bill. Kalshi put Democratic control of both chambers at about 61% on Thursday [11], leaving roughly 39% for every other result [23]. Under a Democratic Congress, Cuomo said, lawmakers could either seek to roll back the agencies' crypto initiatives or work with the Trump administration to pass the full CLARITY Act [12]. In the remaining case the Senate is still short of the votes that the 49-50 cloture count showed were missing [8].

I think donor concentration is a smaller regulatory risk than the totals suggest. The Senate count already turned on Democratic votes, and the objection reported in September concerned Trump's businesses [7]. If that objection is the binding one, moving the $23.2 million from opposing Democrats to supporting them buys goodwill and leaves the count where it is. Crypto Briefing wrote that spreading support more evenly "may open doors, but it will not settle those policy questions on its own" [17]. Cuomo argues the opposite. "You need Democrats to pass the bill. You need Republicans. You have to be more balanced," he said [5]. If a Democratic majority moves to unwind the agencies' crypto rules and names the industry's campaign spending as a reason, the totals mattered more than I think.

CLARITY would divide authority over digital assets between the SEC and the CFTC [18]. Until a law like it passes, Crypto Briefing wrote, the rules for tokens, exchanges and custody can shift with whoever runs those two agencies [16]. Cuomo warned that regulators' guidance and enforcement priorities can flip quickly after an election [15]. He has a commercial stake in the outcome. Crypto Briefing noted that OKX and the ICE venture he co-chairs are both building businesses that depend on predictable rules for trading and tokenization [10].
