Tesla's Cybercab rider guide asks passengers to sit exactly like drivers

The robotaxi has no steering wheel, but the rider guide caps recline at 35 degrees from vertical. Airbags and crash-test dummies are still built for a driving posture, and the federal injury record barely exists.

Why it matters

"You can really just sleep here," a Tesla enthusiast said in a video posted on X, reclining what used to be the driver's seat of a matte gold Cybercab [2]. The seat goes back that far because the car has nothing for a driver to hold [1]. Tesla's rider guide sets a limit anyway: 35 degrees from vertical, belt snug across the hips, both feet flat on the floor [3]. Tesla did not respond to WIRED's questions for the story [5].

Everything under the trim was validated for that posture. Today's standards generally assume an upright occupant with the belt across the hips, airbags are configured for that geometry, and the dummies used in crash tests have inflexible pelvises, so they physically cannot slouch [13]. The regulator's stated reason for opening the question is that people will sit differently. A NHTSA spokesperson told WIRED the agency "decided to explore reclined occupants as a starting point for automated vehicle occupant safety based on the potential that occupants may choose to ride in a reclined posture if driving was no longer necessary" [12].

A belt built for an upright body does something else to a reclined one. It tightens around the soft belly instead of the hard, bony pelvis and pushes hard, and the injuries WIRED lists are internal bleeding, lower spine and pelvis damage, and harm to internal organs [15]. Lower leg and foot injuries also get more common when belts are not worn properly, and those are the ones that affect everyday mobility after recovery [16].

The field record behind all of this is thin. US federal safety data identify 42 people killed in crashes over the past decade whose seat backs were coded reclined, not normal upright [7][8]. That is about four a year. WIRED reports the figure is likely an undercount. Becky Mueller, a senior research engineer at the Insurance Institute for Highway Safety, said "it's really hard to identify people who are sitting out of position" [9]. Crashes move bodies, and responders are extricating people quickly, not recording seat angles [10]. The NHTSA spokesperson said field data for reclined occupants is sparse [11].

For a company that wants a different cabin layout, the route today is a special government approval, and it can be long [17]. Zoox, the Amazon subsidiary, built a bidirectional vehicle with no steering wheel and benches facing each other [18]. It tried in 2022 to self-certify that the vehicle met federal safety standards, and the federal government did not accept it [19]. Mueller said the usual objection is process: "That's the big excuse: 'Oh, we can't revisit this regulation because it's such a hassle to open it back up, to go through the whole process'" [20]. She said autonomous vehicles are finally pushing regulators to open up "some of these archaic rules", and that "It's a good time to make sweeping changes" [21].

When a feature's value depends on a posture the testing never covered, an operator can change what it promises or change what it validated. Only the promise is inside an operator's control this quarter. Tesla's guide says the upright position "reduces the risk of injury in a collision or sudden stop" [4]. A seat that mechanically stops at 35 degrees delivers that without asking anyone to read a guide, and it costs Tesla the video of a passenger asleep in the front of a car with no wheel.

What to watch

  • Whether NHTSA's reclined-occupant work turns into a proposed rule, and how long the studies and public comment period run.
  • Whether Tesla enforces the 35-degree limit in the Cybercab seat hardware or leaves it as guidance in the rider guide.
