The CFTC opened a 60-day consultation on compute derivatives on Aug. 19. The design question underneath it, which index a hedge settles against, decides whether the hedge works at all.

The order of operations is the part worth reading twice. The Office of Information and Regulatory Affairs logged the CFTC's request on Aug. 13 [8]; the Commission issued it on Aug. 19 [1], six days later [21]. Comments run for 60 days after publication in the Federal Register [4]. If publication tracks the release, the window shuts around Oct. 18, roughly 13 days after CME's Oct. 5 target date [20]. The contract lists, and then the market explains to the regulator what the questions should have been.
Non-storability is where the mechanism actually bites. A grain future is tethered to spot by anyone with a silo and a cost of carry. An unused GPU-hour cannot be warehoused and sold next month [13]. A working paper built on market data from Silicon Data and Ornn concludes that the cash-and-carry relationship therefore breaks down, leaving futures to reflect expected rental prices plus a risk premium, with longer-term rental agreements offering only an upper bound [14]. Kelly Littlepage, founder of OneChronos, put it to Axios more bluntly: compute "fails every measure of being a commodity" [12].
That has a practical consequence for anyone planning to put these contracts in a hedge book. CME's two futures settle against Silicon Data's H100 and B200 rental indexes, which track on-demand pricing for two Nvidia generations [6], each contract representing a month of GPU rental [7]. Capacity varies by chip, location and contract terms [16], so a company renting H200 chips in one region is not fully hedged by an index assembled from different locations and commercial terms [15]. The residual sits on the renter's book. The exchange sells a monthly settlement, not a match to your procurement.
The three US proposals differ precisely on that seam. ICE's planned cash-settled contract uses the NATIVX COIL Index, which normalises tokenised compute and connectivity by energy use [9]. Architect Financial Markets, which acquired the CFTC-designated contract market IMX Health, plans contracts across multiple GPU vendors and models and an arrangement with Compute Desk meant to link paper to physical capacity through exchange-for-physical trades [10]. That last one is the only design in the set trying to attach the derivative to delivery rather than to a survey of quotes. Kalshi's forward curves for Nvidia rental prices remain reference data, though Kalshi said related block trades and underlying GPU contracts were available [11].
The consultation's scope hints at where the CFTC's attention really sits. It asks about cash-market size and liquidity, oversight and manipulation, customer protection, and perpetual compute futures [3]. In June the agency put 67 questions to the market on energy perpetuals, covering benchmarks, funding payments and links to physical markets [17]. The same three concerns transfer to compute almost unchanged, and a thin, opaque cash market is the manipulation surface for any index built on it.
Demand supplies the commercial case, thinly. Equinix said AI-related projects made up 60% of its largest first-quarter deals [18], but that is infrastructure contracting, not GPU rental exposure [18]. Chairman Michael S. Selig framed the request as a first step toward clear rules of the road for American compute markets [2]. CME is the only one of the three with a public date [19], and it goes first.

The CFTC issued a request for comment to inform its understanding and oversight of derivatives markets in compute on Aug. 19, 2026 (Release Number 9286-26).

CFTC Chairman Michael S. Selig said: "America cannot win the AI race without a robust derivatives market for compute" and called the request "the first step toward establishing clear rules of the road for American compute markets."
The request seeks comment on the size, liquidity and other considerations of compute cash markets, market oversight and manipulation concerns, customer protection, and perpetual compute futures, and welcomes comment on all aspects of compute markets.
Comments will be accepted for 60 days following publication in the Federal Register.
CME's product page gives Oct. 5 as the planned launch date for its GPU-rental futures, subject to regulatory review.

Strong documentary base, thin market data
The core regulatory act rests on the CFTC's own release with a release number, date, named quotes and an enumerated scope. Exchange details are sourced to CME's product page and contract notice, ICE's stated index, and Architect's acquisition of a designated contract market, and the pricing-theory objection is anchored in a named working paper and a named practitioner critique. What is missing is any quantitative market evidence — no volumes, open interest, liquidity measures or comment-window dates — which caps the score.
Announced and dated, not yet transacting
Adoption is almost entirely prospective. CME has a dated target launch but no live contracts in the supplied record; ICE and Architect have no announced day; the only live product, Kalshi's forward curves, is explicitly reference data rather than tradable. Architect's purchase of a designated contract market is real institutional commitment, and Equinix's 60% AI-deal share shows underlying demand for capacity, but that measure covers infrastructure agreements, not GPU rental futures. No usage, volume or hedging figures appear anywhere in the sources.
Framing outruns demonstrated hedging utility
The rhetorical framing — compute as the commodity of the intelligence economy, indispensable to winning the AI race — sits well ahead of what the record shows: no contract trading yet, no liquidity data, and a structural objection that compute's non-storability breaks the spot-futures arbitrage link that normally makes such hedges reliable. The regulator is itself asking how large and liquid the cash market is, which is an admission that the answer is not established. The gap is moderate rather than severe because the underlying institutional activity is concrete and dated, and the reporting is careful to caveat the Equinix demand figure and the H200 basis mismatch.
Nearly every voice has a position in the outcome
Sourcing is dense with interested parties. Three exchanges stand to earn listing and clearing revenue from the products described; index providers Silicon Data and NATIVX are embedded in the settlement design; the working paper that supplies the pricing analysis used data supplied by Silicon Data and Ornn, both market participants; the loudest critic, OneChronos's founder, is separately seeking approval for a competing compute marketplace; and the regulator's framing advances an institutional mandate over a new asset class. The score is high because these interests are pervasive, tempered slightly by the reporting disclosing them plainly.
Solid on facts, unresolved on status and timing
Confidence is supported by a primary regulatory document and specific, checkable exchange artifacts, and by both sources converging on the basic shape of the story. It is held down by an unreconciled status conflict — the trade report describes the consultation as unpublished and pending OIRA review while the CFTC release shows it issued on Aug. 19 — by the absence of a Federal Register date that would fix the comment-window close, and by a two-publisher cluster with no independent market data.
