Oracle's severance formula needs 23 years of service to reach its 26-week cap
An internal FAQ viewed by Business Insider pays departing Oracle staff four weeks of base salary plus one week a year, cancels unvested stock and ends corporate bonus eligibility. Salesforce accrues three weeks a year.

What happened
- Staff on corporate bonus plans lose eligibility for future payouts, while those on sales or consulting plans may still collect bonuses earned under their plan terms.
- A recent filing shows Oracle's workforce fell by 21,000, or 13%, in the fiscal year that ended May 31, before this round of notifications began on Monday.
- CFO Hilary Maxson used an employee town hall this week to talk about being thoughtful with time and money, without addressing the layoffs directly.

Why it matters
- cost The 26-week headline is reachable only after 23 years, so mid-tenure staff absorb most of the reduction.
- constraint Cancelling unvested RSUs weakens the retention hold on everyone who stays, because anyone who expects to be in a later round now values that unvested balance at zero when weighing an outside offer.
- exposure Vested options push a cash decision onto the leaver, who has three months, or one month on some acquisition grants, to fund a strike price after the paycheck stops.
- precedent With Oracle's terms printed next to Salesforce's 30 weeks and Microsoft's 39, an HR team writing its own schedule this quarter has a published floor to argue against.
The cap binds only at the very long end. Oracle's formula pays four weeks of base salary for a first year of service and one additional week for each year after that, with six months or more in the final year counting as a full year [3]. Reaching the 26-week maximum therefore takes 23 years of service: four weeks plus 22 [20]. Someone ten years in leaves with 13 weeks [21]. Payment lands about three weeks after the employee signs the agreement and returns company property [4].
Business Insider set those terms beside two peers. Salesforce's standard policy runs up to 30 weeks, with a floor of 9 or 13 weeks depending on role, and adds three weeks per year of service [14]. Microsoft's summer round offered up to 39 weeks of base pay, a minimum of 60 days, and one or two extra weeks per six months of service depending on seniority [15]. Oracle's ceiling sits 13 weeks below Microsoft's, about two-thirds of it [22], and its per-year accrual is a third of Salesforce's [23]. Business Insider called the Oracle package comparatively less generous than other Big Tech offers of the past year [16].
Unvested stock options are canceled when employment ends, vested options generally have to be exercised within three months, and some grants inherited from acquired companies allow one month [6]. Unvested RSUs are canceled; previously vested ones stay in the employee's Fidelity account [7]. Participation in the employee stock purchase plan ends on the termination date, and contributions are refunded without interest unless the departure falls in the September 16-30 or March 16-31 purchase windows, when the money buys stock instead [8]. Corporate bonus plan participants lose eligibility for future payouts, while sales and consulting plans pay what the plan terms say was earned [9]. Accrued vacation is prorated and paid out; unused sick leave is not, unless law requires it [11]. Anyone rehired within six months may have to repay part of the severance [5].
The payroll context is on the record. Business Insider reported last month that Oracle had drawn up plans for double-digit percentage layoffs on some teams to reduce payroll while it takes on billions in debt to fund AI infrastructure [12]. A recent filing puts the fiscal 2026 workforce decline at 21,000, or 13%, in the year that ended May 31 [13]. At that ratio the company began the year with roughly 161,500 people [24].
Executives did not address the layoffs directly at an employee town hall this week, though CFO Hilary Maxson told staff the company needs to be "thoughtful" about where it spends time and money [17]. "I don't mean doing more with less, which is a phrase that I really, really don't like," Maxson said [18]. "It means simplifying processes that don't help customers and making clear choices on where we're going to use our resources where they have the greatest impact" [19].
Severance schedules are lawyers' documents shaped by local statute, and comparing them across companies means comparing different job mixes and different countries. Those caveats sit in the fine print. The headline number a recruiter or an employment lawyer will quote back is now four weeks plus one per year, capped at 26, with unvested equity at zero [1][3][6].
What to watch
- Whether Oracle's next filing quantifies this round the way the fiscal 2026 filing quantified the 21,000-person decline.
- Whether Salesforce or Microsoft trim their published maximums of 30 and 39 weeks while capex spending continues.
- Whether the clause requiring repayment of severance by anyone rehired within six months shows up in contractor terms instead.
